Yacht Chartering Terms and Conditions
1. Booking and Payment:
a. A booking is confirmed upon receipt of a deposit, as specified in the booking confirmation.
b. Full payment is required before the charter start date.
c. Payment methods accepted will be provided upon booking confirmation.

2. Cancellation and Refund Policy:
a. Cancellations made by the client:
- If canceled more than 60 days before the charter start date, a full refund of the deposit will be provided.
- If canceled between 30 to 60 days before the charter start date, 50% of the deposit will be refunded.
- If canceled within 30 days of the charter start date, no refund will be provided.
b. Cancellations made by JULY Yachts due to unforeseen circumstances:
- A full refund of the deposit will be provided.
c. Weather and Safety-Related Cancellations:
- If the captain deems conditions unsafe, an alternate date will be offered, subject to availability.
- If no suitable alternate date is available, a full refund of the deposit will be provided.
3. Charter Duration and Schedule:
a. Charter duration and start/end times will be specified in the booking confirmation.
b. Delays in departure due to late arrival of guests will not extend the charter duration.
c. Overtime charges may apply if the charter exceeds the scheduled end time.

4. Charter Responsibilities:
a. The client is responsible for providing accurate guest details and complying with passenger limits set by maritime regulations.
b. The client is responsible for any damages caused to the yacht or its equipment during the charter.
5. Insurance:
a. The yacht is insured for marine risks, but personal belongings of the client are not covered. Clients are encouraged to obtain personal travel insurance.
6. Prohibited Activities:
a. Smoking is strictly prohibited inside the yacht and cabins.
b. Possession or use of illegal substances is strictly prohibited.
c. Diving off the yacht is permitted only in designated areas.
7. Safety and Navigation:
a. Clients must adhere to the captain's safety instructions during the charter.
b. The captain reserves the right to alter the route or cancel the charter due to safety concerns.

8. Force Majeure:
JULY Yachts shall not be held liable for any delays or cancellations due to circumstances beyond our control, such as adverse weather, natural disasters, or government regulations.
9. Governing Law and Jurisdiction:
These terms and conditions shall be governed by and construed in accordance with the laws of [jurisdiction]. Any disputes arising out of or related to this agreement shall be subject to the exclusive jurisdiction of the courts located in [jurisdiction].
By confirming the booking and making the required payment, the client agrees to abide by these terms and conditions.

10. Crew and Services:
a. The yacht charter includes a professional crew, including a captain and crew members, to ensure a safe and enjoyable experience.
b. Additional onboard services, such as catering, water sports equipment, or entertainment, may be available upon request and subject to additional charges.
11. Guest Conduct:
a. Guests are expected to conduct themselves in a respectful and considerate manner towards the crew, other guests, and the environment.
b. Any disruptive or inappropriate behavior that poses a risk to the safety or enjoyment of others may result in immediate termination of the charter without a refund.
12. Provisions and Dietary Requirements:
a. Clients are welcome to bring their own food and beverages or request catering services.
b. Please inform JULY Yachts of any specific dietary requirements or allergies at least 72 hours before the charter start date.
13. Children and Minors:
a. Children are welcome on board, and life jackets will be provided for their safety.
b. Minors (under 18 years) must be accompanied by a parent or legal guardian.

14. Yacht Availability:
a. Yacht availability is subject to change and will be confirmed upon booking.
b. In the rare event of unforeseen circumstances where the booked yacht becomes unavailable, JULY Yachts will offer an alternative yacht of similar size and quality, subject to the client's approval.
15. Privacy Policy:
a. JULY Yachts respects the privacy of its clients and will not share any personal information with third parties without consent, except as required by law.
16. Photography and Media:
a. JULY Yachts may take photographs or videos during the charter for promotional purposes. Clients who do not wish to be photographed must inform the crew.
17. Amendment to Terms and Conditions:
a. JULY Yachts reserves the right to amend these terms and conditions at any time. Clients will be notified of any changes in writing.

19. Weather and Itinerary Changes:
a. The charter itinerary is subject to change based on weather conditions and at the captain's discretion to ensure the safety and comfort of all guests.
b. JULY Yachts shall not be held responsible for any missed ports of call or itinerary adjustments due to weather-related circumstances.
20. Yacht Return and Cleaning:
a. The yacht must be returned to the agreed-upon location at the designated end time of the charter.
b. Clients are responsible for ensuring the yacht is left in a reasonably clean and tidy condition. Excessive cleaning required beyond normal wear and tear may incur additional charges.
21. Fishing and Marine Life:
a. Fishing may be permitted during the charter, subject to local regulations and licensing requirements.
b. Clients are requested to respect marine life and refrain from any activities that may harm or disturb the natural environment.
**22. Loss or Damage to Personal Belongings:**
a. JULY Yachts shall not be held responsible for any loss, theft, or damage to personal belongings brought on board by clients or guests.
b. Clients are advised to keep valuable items secured and to carry their own insurance for personal belongings.
**23. Equipment Usage and Safety:**
a. Clients are responsible for using any equipment, including water sports equipment, in a safe and responsible manner.
b. Any damages to equipment due to misuse or negligence will be the responsibility of the client.
**24. Disembarkation Process:**
a. Clients must adhere to the disembarkation process as directed by the crew upon the completion of the charter.
b. The client will be responsible for any additional costs incurred due to late disembarkation.
**25. Environmental Responsibility:**
a. Clients are encouraged to minimize their environmental impact during the charter by conserving water, limiting waste, and respecting marine life and ecosystems.
**26. Intellectual Property:**
a. All materials, logos, and content provided by JULY Yachts are protected by intellectual property rights and may not be reproduced or used for commercial purposes without prior written consent.
**27. Force Majeure:**
a. JULY Yachts shall not be held liable for any delays or cancellations due to circumstances beyond our control, such as adverse weather, natural disasters, or government regulations.
**28. Governing Law and Jurisdiction:**

**31. Yacht Damage and Repairs:**
a. In the event of damage to the yacht caused by the client or their guests, the client will be held financially responsible for repair costs, which will be deducted from the security deposit or charged separately.
b. Any damages or malfunctions discovered during the charter should be reported to the crew immediately to avoid liability.
**32. Safety Briefing:**
a. Before departure, a safety briefing will be conducted by the crew to familiarize guests with emergency procedures, safety equipment, and onboard guidelines.
b. All guests must participate in the safety briefing and adhere to safety instructions throughout the charter.
**33. Liability Limitation:**
a. The liability of JULY Yachts shall be limited to the amount paid by the client for the charter.
b. JULY Yachts shall not be held liable for any injury, loss, or damages suffered by the client or their guests during the charter, except for cases of gross negligence or willful misconduct.
**34. Medical Conditions and Emergencies:**
a. Clients are responsible for informing the crew of any medical conditions or dietary restrictions that may require special attention during the charter.
b. In case of a medical emergency, the crew will provide reasonable assistance, but clients may be required to seek professional medical care at their expense.
**35. Exclusion of Third-Party Suppliers:**
a. Any third-party services, tours, or activities booked by clients independently of JULY Yachts shall be subject to the terms and conditions of the respective suppliers. JULY Yachts shall not be responsible for any issues arising from such bookings.
**36. Complaints and Feedback:**
a. Any complaints or concerns during the charter should be communicated to the crew promptly to allow for immediate resolution.
b. Clients are encouraged to provide feedback to help us continually improve our services.
**37. Yacht Maintenance and Repairs:**
a. In the unlikely event that the reserved yacht becomes unavailable due to unforeseen maintenance or repairs, JULY Yachts will offer an alternative yacht of similar size and quality, subject to the client's approval.
**38. Currency and Payment:**
a. All transactions will be conducted in the currency specified in the booking confirmation.
b. Any additional fees, including local taxes and charges, will be communicated to the client in advance.
**39. Special Events and Charters:**
a. For special events or customized charters, specific terms and conditions may apply, which will be provided in writing and agreed upon by both parties.

**41. Intellectual Property and Marketing:**
a. Clients grant JULY Yachts the right to use photographs and videos taken during the charter for marketing and promotional purposes, unless otherwise specified in writing.
**42. Travel Documents and Visas:**
a. It is the client's responsibility to obtain all necessary travel documents, visas, and permits required for the charter destination(s).
b. JULY Yachts shall not be held responsible for any issues arising from the client's failure to comply with immigration requirements.
**43. Client's Obligation to Comply:**
a. Clients are responsible for complying with all laws, regulations, and requirements of the charter destination(s).
b. JULY Yachts reserves the right to terminate the charter without refund if the client or their guests engage in any illegal activities.
**44. Minimum Age Requirements:**
a. Clients must meet the minimum age requirement set by maritime regulations for operating certain water sports equipment during the charter.
**45. Yacht Capacity and Passenger Limits:**
a. The maximum number of guests allowed on board shall not exceed the passenger capacity specified for the reserved yacht.
b. The yacht crew shall have the authority to refuse boarding to any additional guests beyond the designated capacity.
**46. Special Requests and Add-Ons:**
a. Additional services or special requests made by clients may be subject to additional charges and availability.
**47. Insurance Coverage for Guests:**
a. Clients are advised to obtain travel insurance covering medical emergencies, trip cancellations, and personal belongings for all guests on the charter.
**48. Noise and Music:**
a. Guests are requested to keep noise levels at a considerate level, especially during evening hours, to respect neighboring vessels or residences.
**49. Yacht Decor and Furnishings:**
a. Clients are prohibited from altering or removing any yacht decor or furnishings without prior approval from the yacht crew.
**50. Environmental Conservation:**
a. Clients are encouraged to practice responsible waste disposal and adhere to any environmental guidelines provided by the yacht crew.
**51. Amendment to Terms and Conditions:**
a. JULY Yachts reserves the right to amend these terms and conditions at any time. Clients will be notified of any changes in writing.
